These terms apply to your use of the HolidAI iPhone app and this website (together, “HolidAI”). HolidAI is provided by Gareth Tuvnes, a sole trader trading as Cre-aTuv Media, based in the United Kingdom (“we”, “us”). By using HolidAI you agree to these terms. If you do not agree, please do not use HolidAI.

1. What HolidAI is

HolidAI is a holiday search and recommendation service. It helps you find and compare places to stay, suggests ideas using artificial intelligence and links you to third-party booking partners.

HolidAI is not a travel agent, tour operator or accommodation provider. We do not sell travel, take payments for bookings or provide the accommodation shown. The stays, prices and availability you see after tapping “See stays” or in the “Map of stays” come from our partner Stay22 and the booking sites it works with.

2. Bookings are made with our partners

When you choose to book, you leave HolidAI and deal directly with a third-party partner, such as Booking.com, Agoda, Expedia, Hotels.com or Vrbo, reached through our partner Stay22. Your booking is a contract between you and that partner (or the accommodation provider), on their terms and conditions and privacy policy. The partner is responsible for the booking, payment, changes, cancellations, refunds and the accommodation itself.

Prices, availability, photos and descriptions can change and are ultimately set by the partner. Always check the final details on the partner’s site before you pay. A trip saved in “My Trips” is a reminder for you only; it is not a booking or a reservation.

3. AI answers

Ask Holid-Ai uses an AI model to generate answers. AI answers are for inspiration only and may be incomplete, out of date or wrong. They are not professional travel, legal, visa, health or safety advice. Please check important information, such as prices, availability, entry requirements and travel advice, with the booking partner and official sources (for example GOV.UK foreign travel advice) before relying on it.

4. Your account

  • You must be at least 18 to create an account or make bookings through our partners.
  • Give accurate information and keep your password secure. You are responsible for activity on your account.
  • You can delete your account at any time in the app (Profile, then Delete Account). This also deletes your profile photo, favourites and saved trips. See our privacy policy for details.

5. Acceptable use

You agree not to:

  • use HolidAI for anything unlawful, fraudulent or harmful;
  • send content to the AI assistant or to us that is abusive, hateful, sexually explicit, infringes someone else’s rights, or contains other people’s personal data without permission;
  • try to get around security measures, access other people’s accounts or data, or interfere with how HolidAI works;
  • use bots, scrapers or automated tools to access HolidAI, or overload our systems;
  • copy, resell or commercially exploit HolidAI or its content without our written permission; or
  • try to make the AI assistant produce harmful or misleading content.

We may suspend or close accounts that break these terms, and may remove or limit access to features to protect HolidAI and its users.

6. Our content

HolidAI, including its name, logo, design and software, belongs to us or our licensors. You may use HolidAI for your own personal, non-commercial holiday planning. Partner names, logos and listing content belong to their respective owners.

7. Availability and changes

HolidAI is currently provided free of charge. We work to keep it running smoothly but do not promise that it will always be available, error-free or that any particular feature, partner or stay will remain available. We may change, suspend or withdraw HolidAI or any feature at any time.

8. Our liability to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under the law of England and Wales, including your rights as a consumer under the Consumer Rights Act 2015.

Subject to that:

  • we are not responsible for bookings, accommodation, payments, prices, cancellations or anything else provided by our partners or accommodation providers, or for their websites and apps;
  • we are not responsible for loss or damage caused by relying on AI answers without checking them;
  • we are not liable for losses that were not reasonably foreseeable, or for business losses (HolidAI is for personal use only); and
  • because HolidAI is provided free of charge, our total liability to you for all claims relating to HolidAI is limited to £100.

9. Changes to these terms

We may update these terms from time to time. We will post the new version here with a new effective date and, if the changes are significant, tell you in the app. If you keep using HolidAI after a change, the new terms will apply.

10. Law and disputes

These terms are governed by the law of England and Wales. Any dispute will be dealt with by the courts of England and Wales, but if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
